Terms & Conditions

Last updated: [date]

1. About these terms

These terms and conditions apply to all towing, tilt tray, transport, machinery transport, vehicle transport, container hire and related services provided by AMAX Towing & Transport ("AMAX", "we", "us", "our"), ABN 48 737 083 155, based in Whyalla, South Australia. By booking a service with AMAX, whether by phone, through our website, or in person, you agree to these terms.

2. Quotes and pricing

Quotes provided by AMAX are estimates based on the information supplied at the time of the request. Final pricing may vary if the actual job differs from what was described (for example, additional distance, access difficulties, extra time on site, or a heavier or larger load than stated). Where possible, we will let you know before starting work if the price is likely to change. Quotes are valid for [30] days unless otherwise stated.

3. Bookings and scheduling

Bookings are confirmed once accepted by AMAX, whether verbally, by phone, email, or through our website quote form. Estimated arrival and completion times are provided in good faith but are not guaranteed. Delays can occur due to traffic, weather, road conditions, prior jobs running over, or circumstances outside our control.

4. Cancellations and rescheduling

We understand plans change. If you need to cancel or reschedule a booking, please contact us as early as possible. [Insert your actual policy here - for example: cancellations made with less than X hours' notice, or after a truck has already been dispatched, may incur a call-out or cancellation fee.] For emergency towing, if a truck has already been dispatched to your location and you cancel after dispatch, a call-out fee may apply.

5. Payment terms

Payment is due [on completion of the job / as invoiced, within X days], unless a separate account arrangement has been agreed in writing with AMAX in advance (for example, for regular commercial or government clients). Accepted payment methods: [insert: EFTPOS, bank transfer, credit card, account invoicing, etc.] Late payment may incur [insert late fee policy, if any]. AMAX reserves the right to require payment before releasing a vehicle, load or container where payment has not been arranged in advance.

6. Your responsibilities

When booking a service, you agree to: - Provide accurate information about the vehicle, machinery, load or item to be transported, including its size, weight and condition. - Ensure safe and reasonable access to the pickup and delivery locations. - Disclose any known mechanical issues, hazards, or special handling requirements before the job begins. - Remove personal belongings and valuables from vehicles prior to towing or transport, where reasonably possible. AMAX is not responsible for personal items left inside a vehicle. - Not request transport of dangerous, illegal, or prohibited goods without prior disclosure and agreement. If information provided is inaccurate and this affects the job (for example, an underquoted weight requiring different equipment), AMAX may adjust pricing, reschedule, or decline to proceed.

7. Our responsibilities and liability

AMAX will take reasonable care when towing, loading, transporting and unloading any vehicle, machinery, equipment or goods. AMAX is not liable for: - Pre-existing damage, wear, or mechanical faults not caused by us. - Damage arising from inaccurate or incomplete information provided about the item being transported. - Delays caused by circumstances outside our reasonable control, including weather, road closures, traffic incidents, or mechanical failure of our vehicles. - Loss or damage to personal items left inside a vehicle during towing or transport. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited under that law, it is limited, at our option, to the resupply of the service or the cost of having the service resupplied. AMAX holds [public liability / goods in transit] insurance. [Insert actual insurance details once confirmed - do not publish this section with invented coverage details.]

8. Goods in our care (bailment)

While a vehicle, item of machinery, or piece of equipment is in our possession for towing, transport or storage, we act as a bailee and will take reasonable care of it consistent with industry practice. This is a general statement of reasonable care during transit and does not constitute a warranty against all loss or damage. [This clause should be reviewed by a solicitor and aligned with your actual insurance coverage before publishing - bailment liability for towing operators is an area with specific legal exposure.]

9. Uncollected vehicles and storage

Where a vehicle, item of machinery, or container is not collected within a reasonable time after we notify you it is ready for collection, AMAX may charge a storage fee for each day it remains uncollected, at the rate of [insert rate]. [This section needs specific legal review. South Australian law sets out particular rights and processes for towing and storage operators dealing with uncollected vehicles, including notice requirements and, in some circumstances, a right to sell or dispose of an uncollected vehicle to recover costs. Do not rely on the paragraph above as a substitute for confirming your actual rights and obligations under SA legislation with a solicitor.]

10. Dangerous or prohibited goods

AMAX does not transport dangerous, hazardous, illegal or prohibited goods without prior written agreement and any required permits or documentation. If undisclosed dangerous goods are found during a job, AMAX may refuse to proceed and additional charges may apply.

11. Website use

The AMAX website and its content (including text, images, logos and design) are owned by AMAX or used with permission, and may not be copied or reused without our consent. We aim to keep information on this website accurate and up to date, but we don't guarantee it is free of errors. Quotes generated or estimated through the website are indicative only and subject to confirmation. Our website may link to third-party sites (for example, Facebook or Google Maps). We aren't responsible for the content or practices of those sites.

12. Limitation of liability

To the extent permitted by law, AMAX's total liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim.

13. Governing law

These terms are governed by the laws of South Australia, and any disputes are subject to the jurisdiction of the courts of South Australia.

14. Changes to these terms

We may update these terms from time to time. The current version will always be available on our website.
